  1. An employee who, due to family circumstances or for other reasons, wants to take part of the vacation at a certain time.
  2. A manager experiencing a constant shortage of employees, or who needs to mobilize them to resolve a difficult production situation.

The manager does not have the right to interfere with the employee's desire to share the vacation at his own discretion, while the same actions on the part of the management itself require the employee's consent.

How many parts can the vacation be divided into?

When dividing the vacation, the rule established by Art. 125 of the Labor Code and the corresponding requirement of the International Labor Organization Convention No. 132 of September 6, 2011. Specifically, the duration of at least one part of it should not be less than 14 calendar days. Whether it is possible to break vacation by days is not defined by the Labor Code. Theoretically, the second half of the vacation can be divided into arbitrarily small periods, even consisting of one day.

These actions will not contradict the legislation, although, for sure, they will meet with some resistance from the leadership. In addition, the calculation of benefits for too short a rest period is also somewhat more difficult. For the employee himself, going on vacation for such short intervals cannot be attributed to getting good rest.

When planning to divide his vacation into parts, the employee must clearly know how many vacation days he is entitled to this year, and how he will be able to detail his vacation. After all, perhaps he has been working for less than a year, and his vacation will be less than 28 days. Rest on weekdays

There are different ways in which you can break up your Labor Code leave. It can be divided into parts that include both workdays and weekends. However, the employee has the right to apply for a vacation within five working days. Taking into account the previous weekend and the following, he thus lengthens his vacation by four days.

In fact, the employee rests nine days, of which five are paid - included in the vacation. By applying this breakdown system to the entire fourteen-day period allowed for separation, the employee can increase the total vacation time by ten days. Of course, vacation pay will only be credited for 28 calendar days.

Vacation only on weekends

It makes no sense for an employee to take a weekend vacation, as he would have had a rest these days without it. Nevertheless, such situations are beneficial for the employer, which is why they occur in enterprises. In other words, the employee is given a mandatory 14 days of indivisible vacation, after which the remainder is distributed on Saturdays and Sundays - seven segments of two days are obtained.

Thus, the employer has a full staff of employees who practically do not go on vacation. The only difference is that for weekends falling on vacation periods, wages are charged. From a formal point of view, such a division of annual paid leave into parts does not violate the norms of the Labor Code, but it is still illegal even with the voluntary consent of the employee. Since the employee has the right to leave of 28 days (article 21 of the Labor Code; part 5 of article 37 of the Constitution), which, under the described scheme, will not be implemented. Its constant use can provoke a check by the Labor Inspectorate and the imposition of penalties.

It is worth noting: Often, employees plan vacation activities that can only be done on a weekday (for example, going to the dentist). Sharing additional leave

Additional leave is granted for work in difficult and hazardous working conditions and, together with the main one, exceeds the prescribed 28 days (Article 115 of the Labor Code). Vacation recall

It is possible to call an employee to work before the end of the vacation in case of a production need only with his consent (part 2 of article 125 of the Labor Code). He can use the rest of the vacation at any time of the year at his own choice or add it to the next vacation, which decision is reflected in the issued order. The employee's refusal to fulfill the demands of his superiors cannot be equated with a violation of labor discipline (clause 37 of the Resolution of the Plenum of the Supreme Council No. 2 of March 17, 2004). Vacation pay is calculated depending on the employee's application. If it is written from Monday to Sunday, then the employer will pay vacation pay for 7 days. When the application is written from Monday to Friday, the employee will receive vacation pay only for these days, but in fact he will rest for the same seven days. If the application is written on Saturday-Sunday, then the employee will receive vacation pay for two days off, which he would have walked anyway.

Responsibility for violations

Whether the employer has the right to divide the vacation without the employee's consent is determined by Rostrud Letter No. 2143-6-1 dated July 17, 2009. This action will be illegal, as well as the decision to break the vacation, determine the duration of its parts and the period for which they will fall. The same applies to the issuance of internal regulations prescribing such a division (Article 8 of the Labor Code). Time. Rest only on weekdays

Now let's consider the option when an employee, wanting to save vacation days, does not include weekends. For example, he writes a statement from Monday to Friday. Then he can stretch the 28 calendar days allotted to him for a longer period, but he will no longer receive payment for the days off, adjacent to the vacation. By the way, not everyone understands this. Many employees believe that if they take a vacation from Monday to Friday, they will receive the same amount as if they wrote a vacation application from Monday to Sunday. After all, they rest for a week anyway. But the vacation days will save at the same time ...

Therefore, your task is to explain to the employee that he is wrong. In this variant, he wins only in rest. And he will lose in salary. Consider the same example, just suppose that the employee wrote the application not on May 13, but on May 11. That is, the vacation fell on a working week without days off.

As a result, the accountant has to calculate vacation pay only for four calendar days. The holiday, as I said, is not included in the calculation.

It is the presence of holidays in May that prompts workers to take small holidays. This allows, so to speak, to extend the holiday. However, as I said, holidays are not paid. For comparison: a week vacation, for example from May 7 to 11, will be paid in a smaller amount than a week vacation from May 14 to 18.
