Chapter 1 General Provisions

1.1) This Rule was created on the basis of art. 4 of the Law Transport Law of Poland of November 15, 1984 r. (Journal of Laws 2000, No. 50, paragraph 601, as subsequently amended).
   1.2) The following terms are used in the Rules:

A) Carrier - Bialystok Express company with an office 15-237 Bialystok, Mitskevich St., 80/2, as well as ChTUP KlassTour with an office 230025 Grodno, Zamkovaya St., 11-205
   b) Passenger - a person using the Carriage Service provided by the Carrier on the basis of paid tickets.
c) Carriage Agreement - an agreement concluded between the Carrier and the Passenger at the time of booking a seat on the bus; on the basis of this, the Carrier undertakes to transport for the agreed amount of money the Passenger and his baggage from the selected city to the destination.
   d) Transportation service - a service of transportation by a vehicle on a day booked by a passenger.
   e) Electronic ticket - a document entitling the Passenger to use the Transportation Services at the appointed time, at a specific time and for the agreed and paid cost. An electronic ticket is printed by a Passenger with an online ticketing system.
   f) Vehicle - a road vehicle used by the Carrier to provide transportation services.
   g) Internet ticketing system - a system that allows Passengers to purchase a ticket for a specific Vehicle of the Carrier and print an Electronic Ticket. The system works on the site website


Chapter 2. Booking and ticket purchase

2.1) Booking a seat via the Internet, a ticketing system means concluding a Carriage Agreement and accepting the Rules described here.
   2.2) Carriage service means the final reservation of a place with the need to pay via the Internet ticketing system.
   2.3) The Carrier accepts payment in cash in Vehicles only if there are empty seats on the bus. Price in cash is set by the Carrier.

Chapter 3. The Ride

3.1) The passenger must arrive at the stop indicated in the schedule no later than 10 minutes before departure.
   3.2) The passenger must take the place indicated on his ticket.
   3.3) The passenger must have a printed Electronic Ticket. The carrier reserves the right to refuse a passenger a trip, in the absence of a printed ticket.
   3.4) A passenger who has concluded a contract of carriage on the route Grodno - Bialystok - Grodno valid for one day has the right to use the Hop-On-Hop-Off Ulug:

A) get off at any Carrier stop in Bialystok indicated in the schedule.
   b) board the Carrier’s bus at any Bialystok stop indicated in the Carrier’s schedule.
   c) use any Carrier's Vehicle while traveling between stops in Bialystok.
   d) the number of pick-up and drop-offs from the Carrier’s Vehicle is not limited until the time of departure from Bialystok indicated on the Passenger’s ticket.
e) after the time of departure of the Passenger indicated on the return ticket on the Bialystok - Grodno route, the Hop-On-Hop-Off service ceases to be valid.

3.5) The passenger is obliged to comply with the rules of the order in transport and comply with the instructions of the driver of the Vehicle.
   3.6) The Passenger is responsible for the damage caused to the Carrier (including damage to the property of the Vehicle) and other Passengers according to the general rules described in the Civil Code.
   3.7) A passenger who intentionally or not specifically contaminated the Vehicle is obliged to pay the Carrier a price equivalent to the damage done, but not less than 500 PLN (in words: five hundred PLN).
   3.8) If the Vehicle has safety belts, the Passenger must be wearing these belts throughout the trip.
   3.9) A child under 12 years of age shorter than 150 cm must be transported in a child seat or other device designed to carry children. Accompanying the child must pre-book or independently provide the child with such a chair. The child must be fastened in the safety seat for the entire trip.
   3.10) The Carrier has the right not to let the passenger into the cabin of the Vehicle or refuse to continue the trip without returning the funds spent by the Passenger on the ticket, if the Passenger:

A) does not comply with the Transportation Rules described here,
   b) is in a state after drinking alcohol or under the influence of drugs intoxicating the mind.
   c) behaves defiantly towards other passengers or the driver.

3.11) The legal consequences of the events listed in section 3.9 of this paragraph are borne by the passenger. The use by the Carrier of the powers specified in this clause does not entitle the passenger to demand any compensation and reimbursement of expenses for booking and buying a ticket.
   3.12) It is prohibited to use alcoholic beverages, smoke and use drugs in Vehicles.
   3.13) The carrier will strive to transport the passenger and his baggage in a timely manner, in accordance with the agreed schedule, but for reasons beyond his control, he cannot guarantee this.
   3.14) The Carrier is not responsible for delays and their further consequences caused by administrative factors (border control / police inspection / etc.) or other factors beyond the Carrier’s control (for example, weather conditions, traffic jams).

Chapter 4. Baggage

4.1) Each part of the passenger’s luggage carried in the luggage compartment must be signed with the passenger’s name, in accordance with your ticket. The obligation to sign baggage rests with the Passenger.
   4.2) The passenger has the right to free baggage in the amount of 1 piece and weighing up to 40 kg, with a maximum size of 50x50x80 cm, as well as hand luggage specified in paragraph 4.3 of this chapter.
   4.3) A passenger can take baggage weighing up to 10 kg and dimensions that allow it to be freely placed under the seat for transportation to the passenger compartment. The size of hand luggage should not harass other passengers and prevent them from traveling.
   4.4) In case of excess baggage, you must pre-order and buy an additional ticket. An additional ticket gives the right to carry an additional 2 pieces of baggage with a total weight of up to 40 kg and a maximum size of each 50x50x80 cm, as well as one piece of hand luggage with a maximum weight of 5 kg and a maximum size of 60x40x20 cm.
   4.5) When transporting sports equipment, such as skis, surfboards, you need to buy an additional ticket.
   4.6) The carrier has the right to refuse to accept baggage if it does not meet the requirements set forth in this document.
   4.7) The presence of unusual baggage should be reported by telephone no later than 17:00 on the day preceding the day of departure.
   4.8) The Carrier’s liability for baggage carried in baggage compartments is limited to PLN 1000. In case of transportation of goods of higher value, in particular, electronic equipment, the passenger insures them independently and reports this fact to the driver by transferring baggage.
   4.9) The carrier is not responsible for baggage and items outside the luggage compartment.
   4.10) The carrier is not liable for damage for the loss or damage of transported cash, jewelry, securities, electronic equipment and objects of scientific, artistic or collector.
   4.11) Items left in vehicles due to forgetfulness or other reasons are not subject to the protection and liability of the Carrier.
   4.12) Passengers may file complaints regarding baggage carried in the luggage compartment in writing to the carrier. A prerequisite is an oral complaint to the driver at the time of baggage unloading and receipt from him of a written confirmation of the addition of the complaint indicating the type of damage that has occurred.

Chapter 6. Complaints

6.1) Claims arising in connection with the implementation of the contract of carriage should be sent to the carrier only in writing. The person authorized to file complaints is the passenger or his legal guardian. Complaints submitted by third parties are not considered. When submitting a claim, you must provide the order number.
   6.2) Complaints about services should be provided to the carrier no later than within 2 months from the day the service was performed.
   6.3) All complaints are considered within 14 business days from the date of receipt by the Carrier of a written complaint, taking into account the situation in which there is a need for an additional explanation of the Passenger.

Chapter 7. Refusal of transportation services

In order to return a ticket, no earlier than 600 minutes before the departure of the bus, the passenger must use the "Change" section in the form on the main page of the site.

Chapter 8. Personal data security policy

8.1) in accordance with Regulation 2016/679 of the European Parliament and the Council of April 27, 2016 on the protection of personal data (hereinafter GDPR), we guarantee the confidentiality of the Passenger's personal information that comes to us through the Internet ticketing system.
   8.2) The seller guarantees that the personal data of the buyer will be processed solely for the purposes of the contract and for marketing purposes of the seller.
   8.3) In the cases and under the conditions specified in the GDPR, the Buyer has the right to demand that the processing of his personal data be temporarily or permanently suspended or deleted, if they are incomplete, outdated, untrue or collected in violation of the law or are no longer needed for purposes with whom they gathered, and also has the right to submit a written application to terminate the processing of his personal data.
   8.4) The seller will not process or provide third parties with information about the buyer and the orders made by him.

Chapter 9. Final Provisions

In the case of unsettled provisions and not described in these Rules, the following should apply: Law of November 15, 1984, Transport Law of Poland (consolidated text Journal of Laws 2000, No. 50, paragraph 601, as amended), Law of April 23, 1964 Civil Code of Poland ( Journal of Laws of 1964, No. 16, Pos 93; as amended.)
